MANSFIELD — The parents of a county road maintenance worker who died a year ago have filed a wrongful death lawsuit against Richland County.
Larry W. Arnold, 41, of Fredericktown, was crushed to death Sept. 18, 2006, while working near a hydraulic excavator on Mock Road, near Ohio 546. He was part of a crew from the Bellville outpost of the county engineer’s office.
The maintenance worker’s parents, Richard H. and Helen L. Arnold, say their son was trying to solve a mechanical problem with a malfunctioning motor when he was fatally injured.
They contend the engineer’s office failed to properly service the excavator microswitch when identical problems with the component cropped up several weeks earlier.
The lawsuit also claims supervisors didn’t try to stop Arnold’s crew from working in hazardous locations around the excavator or warn them against hazards involved.
Richland County Commissioners and County Engineer Tom Beck were named as defendants in the lawsuit, filed in Richland County Common Pleas Court, just short of the anniversary of Arnold’s death.
Commissioner Ed Olson said the county’s liability coverage is through the County Risk Sharing Authority, a self-insurance pool used by a large number of Ohio counties.
CORSA generally refers defense of counties named as defendants in civil actions to a Columbus law firm, but no attorney from that firm has been assigned to the case.
The Arnolds say the county road crew was using a Gradall G3WD hydraulic excavator to move gravel when the motor began to repeatedly slow down and rev up. Work crew members tried to fix the problem by standing near the side of the excavator and tapping on or striking the microswitch, a method that worked only briefly, according to the lawsuit.
According to the Arnolds, their son walked to a location behind the driver’s cab to deal with the malfunctioning motor, when the operator — unable to see him — swung the boom around to dump a load into a dump truck. The 41-year-old got caught between the cab and the upper counterweight on the excavator and was crushed.
The Arnolds, who are administering their son’s estate, are seeking $25,000 or more in compensatory damages, along with other damages a jury might award.
Arnold had been employed with the agency since 2004.
2Pool Company Found Negligent in Wrongful Death Lawsuit

On September 25th the parents of a 5-year-old boy who drowned last year at Crofton County Club in Anne Arundel County were awarded more than $4 million in damages.
The judge ordered DRD Pool Service Inc., the county club’s management company, to pay Thomas Free and Debra Neagle Webber $2,000,076 each. The $76 serves as a symbol of Connor Freed’s July 6th birthday. DRD was found negligent for failing to adequately train its lifeguards and properly staff the pool.
On June 22, 2006, when Conner was found floating in the Crofton County Club pool, a 16-year-old lifeguard who had been on the job for three weeks was on duty. Currently, in Anne Arundel County only one lifeguard is required for every 50 swimmers.
Conner was at the pool with a family friend, Paul Carroll, and two other children. The jury did not award a judgment against Carroll who had also been name in the wrongful death lawsuit.
Conner’s parents have started a foundation in their son’s honor called Conner Cares. The foundation works to create standardized and more stringent safety requirements at public pools.
Drowning is one of the most, if not the most, preventable cause of childhood deaths. Businesses and facilities that fail to properly supervise children should be held accountable.

4Wrongful Death Case Settled Over Jail Death

A man died after spending three days in the Mille Lacs County Jail and being denied a visit with a doctor. Before he was arrested he was injured in a car accident. His mother sued the county for wrongful death. The lawsuit was settled for $700,000.For days, he pleaded with Mille Lacs County jail employees to let him see a doctor. But by the time they relented, it was too late, according to the lawsuit filed in U.S. District Court in Minneapolis. Brown died of acute bacterial meningitis associated with a skull fracture from the accident.
The mother felt her son’s civi rights had been denied. The county did not admit they had done anything wrong. The family is glad they can move on now that the lawsuit is over.
5$900,000 settlement reached in wrongful death lawsuit

A Chicago husband whose wife took her own life after she suffered postpartum psychosis recently reached a $900,000 settlement with the doctor and hospital that treated her.
In 2002 Sam Stokes filed a wrongful-death lawsuit against Dr. George Melnyk and Advocate Lutheran General Hospital, alleging that his wife, Melanie, had not been treated for depression in May 200l-almost three months after the birth of the couple’s daughter, Sommer Skyy, reports the Chicago Tribune.
On June 1, 2001, Melanie Stokes was released from the hospital, and shortly after that she disappeared. On June 11 the new mother jumped to her death from a 12th floor Chicago hotel window (JET, July 2, 2001).

| A trial date was set for a wrongful death lawsuit in federal court against a local TV station in connection with a deadly Fort Hood helicopter crash in November 2004.
Seven soldiers died near Moody when their Blackhawk helicopter crashed into KXXV Channel 25’s tower support wires in heavy fog.
Records show Channel 25 had previously notified the Federal Aviation Administration that a light was out on the tower.
More lawsuits stemming from the crash are expected to follow.

Truck Accident Closes Down Lanes On 101 Highway
(CBS) HOLLYWOOD, Calif. A U-Haul truck collided with another vehicle collided on the northbound Hollywood (101) Freeway in Hollywood, trapping one person in the wreckage and closing all but one lane, authorities said.
The accident happened occurred at 2:19 a.m. on the 101, near West Sunset Boulevard in Hollywood, the California Highway Patrol reported.
Firefighters rescued one person from the wreckage using the Jaws of Life, according to Los Angeles Fire Department spokesman Brian Humphrey. The victim’s condition was not immediately determined.
Only one lane was open as of 3:45 a.m., according to the CHP.
